OFFICE ORDER

 

 

Sub: Implementation of the Right to Information Act, 2005

 

      

In partial modification to the office order no. P&T: 14:39:2003:502, Shri Tapas Basu, GM(CP), is hereby, defined as the Appellate Authority(AA) under Section 19(1) of RTI Act to whom appeal by any person aggrieved against the orders of CPIOs can be made. The Appellate Authority shall dispose of all appeals in the manner provided under the RTI Act. The CPIO concerned should furnish information/report to the AA forthwith, as and when asked for.

 

All other terms of the above office order remain unchanged.

 

This issues with the approval of the Competent Authority.

OFFICE ORDER

 

Sub: Implementation of the Right to Information Act, 2005

 

          The existing procedures and designations of officers dealing with RTI Act have been reviewed in the light of the latest provisions of the RTI Act.  Accordingly, the following procedure shall be followed, henceforth:-

 

1.       There shall be a CPIO (Central Public Information Officer) at H.O. and one each at Regional/Branch level and CAPIO at site offices.  The following officers are, hereby, designated as CPIO/CAPIO:-

 

          a)       Shri M.P. Srivastava, DGM(CC & SA/PG), CPIO for H.O.

          b)       RM, NRO, CPIO for NRO

          c)       RM, ERO, CPIO for ERO

          d)       RM, SRO, CPIO for SRO

          e)       RM, WRO, CPIO for WRO

          f)        BM, Vizag, CPIO for Vizag Branch

          g)       BM, Vadodara, CPIO for Vadodara Branch

          h)      BM, Bangalore, CPIO for Bangalore Branch

          i)        SM, Hyderabad, CAPIO for Hyderabad office

          j)        M, Bhopal, CAPIO for Bhopal office

          k)       DM, Lucknow, CAPIO for Lucknow office

 

2.       CPIO for H.O. shall deal with all RTI applicants related to activities of H.O. and matters relating to more than one RO/BO.  He shall reply to queries based on information furnished by the Department/Region/Branch concerned.

 

3.       The CPIOs for the respective Region/Branch offices shall deal with RTI queries for activities relating to their respective offices having regard to the provisions of RTI Act.  The CAPIOs shall receive applications/appeals submitted to them and forward the same immediately to the concerned CPIO/Appellate Authority(AA) for necessary action at their end.  Copies of all replies given to the applicants shall be positively furnished to CPIO/H.O. for records and also filing of consolidated reports, returns to various authorities.

 

4.       All departments and officers should co-operate in time bound manner in furnishing requisite information to the CPIOs at H.O./RO/BO so that reply can be sent within the stipulated time as per RTI Act.

 

5.       Shri S.S. Chaudhuri,  CGM(HR), is hereby, defined as the Appellate Authority under Section 19(1) of RTI Act to whom appeal by any person aggrieved against the orders of CPIOs can be made.  The Appellate Authority shall dispose of all appeals in the manner provided under the RTI Act. The CPIO concerned should furnish information/report to the AA forthwith, as and when asked for.

 

6.       Under the provisions of RTI Act, information as defined under Section 2(f) of the Act are required to be furnished to the applicant seeking information, subject to certain exemption provided in the Act.   Therefore, reference may be made to the Law Department by a CPIO/Appellate Authority on matters involving interpretation of provisions of the Act.  Any reference made to the Law Department shall state specifically the point on which advice is sought. Law Department shall provide clarification/interpretation in accordance with the Law/provisions of the RTI Act to the concerned CPIO/A.A. expeditiously to enable the CPIO/A.A to reply within stipulated time.  S/Shri P.V. Naidu, AGM(Law) and R.K. Kundan, DM(Law) are designated for this purpose.

 

7.       Any 2nd Appeal filed before the Central Information Commission shall be handled by the CPIO in consultation with the Law Department.

 

The above procedure shall come into force with immediate effect and shall supersede all other orders in the above matter.
